Yes. Oaths.co.za™ is legally defensible and fully compliant with South African law.

  • Every certification is performed by a duly appointed Commissioner of Oaths (e.g. Professional Accountant (SA), Chartered Accountant, Auditor, or Attorney).
  • The Justices of the Peace and Commissioners of Oaths Act, 1963 and Regulation 6 of GN R1258 of 1972 govern Commissioners of Oaths and prohibit charging for certification.
  • The Electronic Communications and Transactions Act (ECT Act), 2002 confirms that electronic documents and signatures carry full legal force and evidentiary weight when created and stored reliably.
     

⚠️ Note: Oaths.co.za™ certifies true copies of documents (IDs, passports, driver’s licences, proof of address) for compliance and verification purposes. We do not handle affidavits, sworn statements, or declarations — these still require in-person commissioning under Regulation 10.


Every certification is performed by a duly appointed Commissioner of Oaths, in terms of the Justices of the Peace and Commissioners of Oaths Act, 1963 and its regulations.

  • Never by bots or anonymous staff — only qualified, accountable professionals.
  • Currently, all Commissioners on Oaths.co.za™ are Professional Accountants (SA), registered with SAIPA and in good standing.
  • In future, additional vetted professionals from recognised bodies — including SAICA (Chartered Accountants), IRBA (Auditors), and the Legal Practice Council (attorneys and advocates) — may also serve as Commissioners on the platform.


Oaths.co.za™ certifies only true copies of genuine South African documents. We adhere to a "Gold Standard" for document verification, based on FICA guidelines and industry practices in South Africa.

We require an official, unaltered PDF that explicitly lists the individual's name and physical residential address. Our preferred document is a bank-issued document. If you do not have one of these, you can use one of the other documents on the list below, in the order of preference. 

  1. Bank-Issued Document: A statement or a "Proof of Account Details" letter from a South African bank.
  2. Home Loan or Mortgage Statement: A statement from a financial institution confirming a home loan or mortgage account.
  3. Official Municipal Utility Bill: An invoice for water, electricity, or rates from a local municipality.


⚠️ We do not certify:

  • Green barcoded ID books
  • Documents that list a postal address but lack a physical residential address.
  • Fake, altered, or suspicious documents.
  • Affidavits, sworn statements, declarations, or affirmations (these require in-person commissioning under Regulation 10 of GN R1258 of 1972).


First-time registration and certification is quick. Our service standard during our initial launch period is to certify every client within 60 minutes. This includes identity verification and Commissioner review.


Seamless automated renewals — you won’t even notice. Every 3 months, the Commissioner of Oaths is digitally prompted to re-certify your documents. The process runs in the background, and your updated certified copies will always be ready when you need them — with full professional oversight.


Please note: during periods of high demand, certification may take longer. We continuously review turnaround times to improve client experience.


Oaths.co.za™ is a cloud-based platform with 24/7 access.


Registration never sleeps — you can sign up, upload your documents, and complete biometric and compliance checks at any time, day or night.
Automated onboarding — your account setup, document uploads, and verification pipeline run instantly, even outside of office hours.
Commissioner oversight — every certification must be reviewed and signed off by a duly appointed Commissioner of Oaths. If you register after hours, your documents are securely queued in OathsVault™ and processed at the next Commissioner session.


In short: whether you register at 2pm or 2am, your access and onboarding are seamless — and your certification is completed promptly with full professional oversight.


By law the act of certification is free (Regulation 6 of GN R1258 of 1972).

Your subscription fee is not for certification itself.

Yes. If you have a South African cellphone number (SIM card). 


Oaths.co.za™ works anywhere in the world — whether you’re in London, Dubai, Perth, or Cape Town — as long as your South African SIM can still receive SMS messages from South Africa.


This is because our platform relies on South African mobile networks for SMS verification. If your SIM is roaming and active, you can log in and certify documents from abroad without any issues.


It’s the perfect solution for South Africans overseas who still need certified copies for banks, SARS, CIPC, universities, or compliance back home.


Important: Oaths.co.za™ does not yet support foreign (non-SA) numbers. 

 A valid South African SIM is required.

Oaths.co.za™ certifications are performed strictly in accordance with South African law. Our certifications derive their legal validity from a combination of foundational acts and modern legal precedents:

  • Statutory Authority: The Justices of the Peace and Commissioners of Oaths Act, 1963, and its regulations , which empower Commissioners of Oaths to certify true copies. 
  • Electronic Recognition: The Electronic Communications and Transactions Act, 2002 (ECTA) , which gives legal force to electronic documents and sets the standard for assessing the evidential weight of a digital record. 
  • Case Law: South African courts have demonstrated a clear trend toward a more liberal interpretation of legal requirements, acknowledging that technology can achieve 'substantial compliance' with the core purpose of the law—such as robust identity verification. 
  • Patent Pending: Our proprietary certification process is protected under CIPC Patent Application No. 2025/06893, a testament to our innovative methodology.


Every Oaths.co.za™-certified copy is secured through OathsVault™ Verification:


  • QR Code → each certificate carries a unique QR code that links directly to a live verification record hosted under the Oaths.co.za™ domain
  • Cryptographic Ledger → every certified copy is cryptographically hashed and recorded in a sealed ledger with blockchain level security making tampering instantly detectable 
  • Commissioner Identity → the certifying Commissioner’s name, professional designation, and regulator are embedded in the metadata and displayed on the certificate itself
     

Together, these safeguards ensure that Oaths.co.za™-certified documents retain full evidentiary weight under section 15 of the Electronic Communications and Transactions Act, 2002 (ECTA), which recognises the legal validity of electronic records when secured by reliable processes.


All certifications are conducted by duly appointed Commissioners of Oaths:

  • Legal Appointment: Commissioners of Oaths are appointed under the Justices of the Peace and Commissioners of Oaths Act, 1963 (Act 16 of 1963) and the regulations issued under GN R1258 of 1972 (as amended).
  • Professional Standing: Currently, all Commissioners on Oaths.co.za™ are Professional Accountants (SA) registered with SAIPA, and may in future include other vetted professionals in good standing with recognised bodies such as SAICA, IRBA, and the Legal Practice Council.
  • Traceability: Each certification identifies the Commissioner by name, regulator, and professional designation.
  • Accountability: All actions are audit-logged and subject to oversight under POPIA (s19), as well as the codes of conduct of their professional bodies.
     

This structure ensures that every certification is legally defensible, regulator-compliant, and professionally accountable.


Fraud risk is mitigated through a multi layered compliance framework:

  • Biometric Liveness Detection → ensures the user is a live present human
  • DHA Cross Validation → IDs Driver’s Licences and Passports are validated against Home Affairs databases
  • AML Controls → automated screening against South Africa’s PEP PIP lists and targeted financial sanctions (FIC Act 38 of 2001)
  • Forensic Audit Logs → cryptographically sealed ledger records of Commissioner activity providing tamper proof traceability and aligned with POPIA sections 19 to 22 obligations.


This design does not eliminate fraud risk entirely but it significantly reduces it while directly supporting FICA, AML and businesses compliance programs.
